Hello and welcome to the Gupt Gyan website and all of its linked websites and digital and online services (the "Site" or "Gupt Gyan Site"). The Site is an online shopping, reading, and talking service offered by Gupt Gyan and all of its partners (the "Gupt Gyan" or "We" or "Us"). These Terms of Use describe how to use this whole Site. However, other rules, restrictions, and policies may also apply, such as the Notice of Privacy Practices (NPP) and the Privacy Policy, which may be placed on the Site or linked to from it.
Not Medical Advice
This site's content, products, and services are meant to teach people about health care and medical problems that might affect their daily lives. There is no medical guidance, diagnosis, or treatment in the content, products, or services, and they should not be used in place of it. The advice, diagnosis, or treatment on this site and its services are not provided by doctors, nurses, or other professionals in the health care field. These terms and conditions can be changed at any time by Gupt Gyan. Any changes will take effect as soon as they are posted on Gupt Gyan's Homepage. It is your responsibility to check the agreement often to see if there have been any changes. If you access or use the service, you agree to the agreement as it was when you accessed or used it. Gupt Gyan may give Site visitors the chance to use extra tools or services through this Site from time to time. Before you can use these tools or services, you might have to agree to or get permission to do other things.
Users aged 18 and up are welcome.
Except for our Patient Portal, the Site is only for people who are 18 years or older. This site is not meant for kids younger than 18 years old. People younger than 18 should have a parent or adult help them use this site.
Patients who are at least 18 years old can use our Patient Portal. Individuals aged 13 to 17 are also eligible to receive it as long as their parents or legal guardians give them permission.
Acceptable use
You promise not to:
Break any local, state, national, or foreign laws by using this website for any reason.
You may not use this site to send advertising or other unwanted materials to other people.
You may not use this website to send or post anything that is illegal, offensive, threatening, annoying, abusive, slanderous, hateful, or embarrassing to another person or group.
Try to turn this website off, "hack," or otherwise get in the way of how it works.
break or try to break the Site's security, such as by doing any of the following:
Getting to information that isn't meant for Site users or logging into a computer or account that Site users aren't supposed to be on;
without permission trying to probe, scan, or test how weak a system or network is or to break security or login measures; or
going to or using the Site or any part of it without permission, which is against these Terms of Use or the law where you live.
Use any kind of scraper, crawler, spider, robot, or other automatic tool to get to or copy data on the Site. Deep-link to any part of the Site, or get around our robot exclusion headers or other security measures we may use to keep people from getting to the Site.
Do not use any tool, software, routine, or other thing to try to stop or slow down the proper functioning of this Site or any action occurring on it.
If you break system or network security, you could be sued in civil or criminal court. Gupt Gyan will look into events that might involve these kinds of violations and may work with law enforcement to bring users who are involved in these kinds of violations to justice.
If part of the Site can only be accessed with a user ID and password ("Protected Areas"), you agree to only use the user ID and password that Gupt Gyan gave you to access those Protected Areas. You promise to keep your user ID and password secret and not give them to anyone else. It is agreed that you will be fully responsible for everything that happens under your user ID. Gupt Gyan can refuse to let you into the Site at any time, with or without a reason.
Account set-up
You agree with these things:
When you sign up to use the Site and create an account ("Registration Information"), you agree to give true, accurate, up-to-date, and full information.
You promise to keep the Registration Information up to date and correct so that it is always true, accurate, up to date, and full. Gupt Gyan may stop or close your account if you give them false, inaccurate, out-of-date, or incomplete information, or if they have a good reason to think that the information you give them is false, inaccurate, out-of-date, or incomplete.
You agree that you are solely responsible for keeping your passwords and any actions that happen in connection with your account secret.
You promise that no one else will be able to use your password or get into your account. Your account will not be as safe if you do that.
Order limitations
We can refuse any order you place with us from the Gupt Gyan Store or the Gupt Gyan Marketplace, or we can reduce the amount of any order you place, for any reason. If we decide not to fill your order, we will usually try to let you know through the email address you provided when you made the order.
Gupt Gyan has the right to limit the number of things that can be bought by one person, one household, or one order. Some of these rules may apply to orders made with the same credit card or account, as well as to orders with the same billing and/or shipping address. If these limits are put in place, we will let the customer know. Please keep in mind that some orders are not legal ways to use the Site or buy goods. We let ourselves decide if we want to accept or delete any order for any reason. In our sole judgment, we may also limit or close your account for any reason. At our own choice, Gupt Gyan also has the right to stop sales to dealers or resellers. As used in these Terms of Service, "reselling" means buying or planning to buy any product(s) from Gupt Gyan with the intention of selling those same products to a third party for profit.
Termination of use
That's up to Gupt Gyan. They can close your account or stop you from using the Site at any point. You are responsible for any orders you place or fees you pay before the end date.
Gupt Gyan can change, stop, or end any part of the Site at any time and for any reason, without warning...
Content that users create, like reviews, comments, and other posts on the site
If you send us comments, ideas, suggestions, information, files, videos, pictures, or other materials through our Site (“User-Generated Content”), you agree not to send any User-Generated Content that (1) is harmful, obscene, threatening, harassing, fraudulent, pornographic, or defamatory; (2) violates any person's or organization's privacy, copyright, trademark, trade dress, trade secrets, or intellectual property rights (3) contains or sends a virus or other harmful thing. You promise not to send unwanted emails, phone calls, mail, or use any other way of communication to get in touch with other Site users. You promise Gupt Gyan that you are allowed by law to give all User-Generated Content to Gupt Gyan for the uses and purposes described here. If Gupt Gyan wants to, he or she can use the User-Generated Content in any way they want, without paying anyone anything. This includes, but isn't limited to, copying, editing, deleting the whole thing, adapting, publishing, translating, making derivative works from it, selling and/or distributing it, and/or putting it into any form, medium, or technology around the world. It is not and will not be Gupt Gyan's responsibility to (1) keep any User-Generated Content secret; (2) pay you for any User-Generated Content; or (3) react to any User-Generated Content.
Gupt Gyan doesn't usually look over User-Generated Content that is posted, but they do have the right (but not the responsibility) to look over and change or remove any User-Generated Content that is posted on the Site. It is okay for Gupt Gyan to use the name you give them in connection with any User-Generated Content. The use of a false email address is strictly prohibited, pretend to be someone or something else, or lie about where any User-Generated Content came from in any other way. You are and will always be the only one responsible for what's in any User-Generated Content you post. Any User-Generated Content that you or a third party submits is not the responsibility of Gupt Gyan or any of its companies.
E-Commerce
Payment:
To buy something on the Gupt Gyan Store or the Gupt Gyan Marketplace, you need a legal credit card number, expiration date, and card security code. We may cancel your order or ask for another form of payment if Unfortunately, the credit card you provided us cannot cover the entire amount of your purchase. Your credit card information and other personal information will be collected by Gupt Gyan's approved credit card processor. This information will be used to process your payment for the goods or services you ordered. If you have any problems with how your payment was processed, please email Gupt Gyan at info@guptgyan.co.in. It's clear to you that prices for goods and services can change sometimes.
The credit card you provide at setup will be debited for all charges and fees if you sign up to make regular payments automatically. You have to change your information online if you want to use a different credit card or if your credit card information changes. This could make it take a little longer for you to make online payments while we check your new payment information.
When you pay online, you promise that (i) The details you provide for your bank account, credit card, or debit card are accurate and full; (ii) your bank or credit card company will actually pay the bills you send them; (iii) that you will pay the charges in full, including any taxes that apply; and (v) that you are authorized to use the credit card and credit card information to make a purchase or other transaction.
Prescriptions:
For some items on the Gupt Gyan Store website, you may need a legal prescription from a licensed healthcare provider (“Provider”). Gupt Gyan doesn't support any specific gadget, long-lasting medical equipment, medicine, pharmacy, or pharmacologic product (all of these things are called "Prescription Products"). When a Provider writes a prescription for a Prescription Product, he or she will limit the quantity based on state laws and will only write a prescription if it is in line with his or her professional judgment. There's no promise that a prescription will be made. You agree that you will only use any medications you get from a Provider for yourself. You agree to carefully read all of the information and labels that are given to you about the products and to talk to a doctor or pharmacist if you have any questions about the medication. Gupt Gyan fully respects the patient's right to choose, so if you get a prescription for a Prescription Product from a Gupt Gyan Provider, you can always tell Gupt Gyan to send that prescription to the pharmacy of your choosing. Taking care of fees and charges; insurance:
You are the only one who is responsible for all fees and charges that come with your order from the Gupt Gyan Store. This includes delivery fees, taxes, and any fees your bank charges. There are some items or fees that Medicare, Medicaid, private insurance, an out-of-state workers' compensation payer, or another insurance plan may pay for or repay. No matter what your insurance covers or how much they pay back, you will be responsible for the full price of the item you bought and all charges that come with it. Indemnification
You agree to protect Gupt Gyan from any harm, losses, liabilities, judgments, costs, or expenses (including reasonable attorneys' fees and costs) that go to or are incurred by Gupt Gyan because a third party claims you violated these Terms of Use or applicable law, User-Generated Content and other materials you publish or allow any content you create or access while using the Site to be published on the Site everyone who gains access to the Site using your username and password, or anything else you do on the Site.
Disclaimers
You agree and understand that the Gupt Gyan site and all of its services, material, and information are given to you "as is." Gupt Gyan doesn't offer any warranties, representations, or endorsements, either express or implied, about the service or any goods, information, or services that are offered through it. This includes title, noninfringement, merchantability, and fitness for a particular purpose claims. Furthermore, Gupt Gyan does not promise that using the Gupt Gyan site will be free of technological issues such as not being able to access material, service interruptions, viruses, or worms. You are responsible for setting up enough processes and checkpoints to meet your data input and output accuracy needs.
Site for Gupt Gyan Has Bugs
It's possible for prices, goods, and services to change at any time, with or without notice. If any mistakes are found, they will be fixed. Gupt Gyan also has the right to take back any deal they made and fix any mistakes, missing information, or inaccuracies. This includes after an order has been placed, even if the order has not been confirmed and your credit card has not been charged. This means that if a product or service is listed at the wrong price because of a typo or a problem with the pricing information we get from our suppliers, we can refuse or cancel any orders that are made for that product or service. In this case, we can refuse or cancel the order, even if your credit or debit card was charged after approval. If you cancel your order after item has been charged to your credit/debit card, we will quickly reverse the charge and credit your account for the right amount. Your bank's policies determine when this money is deposited. If you're not happy with what you bought, you can return it according to the Site's return policy.
How accurate and trustworthy the information is
Even though Gupt Gyan tries to make sure the Site is honest and correct, it does not make any claims, warranties, or guarantees about the correctness or accuracy of the Site or its material. It's possible that the Site has typos, other mistakes, or other problems. It's also possible that third parties could add to, delete from, or change the Site without permission. Whenever there is a mistake, please let Gupt Gyan know so that it can be fixed. Gupt Gyan has the right to fix any mistakes on the Site on its own, without warning. The Site's information could be changed or added to at any time, without warning. Also, Gupt Gyan is not responsible for or liable for any information or material posted to the Site by a third party that is not connected to Gupt Gyan.
Putting limits on your responsibility
If you use the site, you do so at your own risk. Whether they be direct, indirect, incidental, consequential, exceptional, exemplary, or punitive, Gupt Gyan has no responsibility for them or other monetary or other damages, fees, fines, penalties, or liabilities that come from or are related to this service, sites that can be accessed through this service, or the content or information provided here. Gupt Gyan is only responsible for the amount you paid for a product or service on our site. Please do not make any other claims against us. Should you be unhappy with the site or service, the only thing you can do is stop using it. The user acknowledges that this paragraph encompasses all features, material, products, and services provided by the site. You might not be able to get rid of or limit incidental or consequential losses in your state, so the above limitation or exclusion might not apply to you.

This includes the truth, suitability for a specific purpose, merchantability, or anything else. Putting a link to a Third Party Site on the Gupt Gyan Site does not mean that the Gupt Gyan Site supports, approves of, or is responsible for that Third Party Site. Gupt Gyan doesn't promise or guarantee any of the goods or services that are sold on any Third Party Site. Jurisdiction
This agreement is governed by the laws of India any dispute or claim that arises from your use of the Gupt Gyan Site. This includes claims for personal harm. The District Court of India in Rajasthan County, India, is the only place where these two parties can file a lawsuit. Anyone who makes a claim on your behalf must also follow these Terms of Use.
